Zelensky enacts NSDC decision strengthening liability for lies in asset declarations.

Ukrainian President Volodymyr Zelensky has enacted the decision by the National Security and Defense Council (NSDC) to approve a bill strengthening liability for declaring false information and failing to submit an asset declaration.

A decree to that effect, No. 26/2021 of January 26, has been published on the website of the head of state, according to Ukrinform.

"To enact the decision of the National Security and Defense Council of Ukraine of January 26, 2021 'On the draft law of Ukraine introducing amendments to the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine to improve liability for declaring false information and failure to submit a declaration by a person authorized to perform the functions of the state or local self-government'," the document reads.

According to the presidential press service, the NSDC approved the bill and recommended that the head of state submit it to the Verkhovna Rada as urgent.

The draft law provides for the return of punishment in the form of restraint or deprivation of liberty for false declaration and failure to file a declaration.

It is proposed to amend Article 366-2 of the Criminal Code (declaration of inaccurate information), providing that the intentional entry of inaccurate information in the declaration, which differs from accurate information by 500 to 2,000 living wages for able-bodied persons, is punishable by a fine of 3,000 to 4,000 non-taxable minimum incomes of citizens or community work for a period of 150 to 240 hours, or restraint of liberty for up to two years, with deprivation of the right to hold certain positions or engage in certain activities for up to three years.

If the person filing a declaration intentionally entered inaccurate information that differs from accurate information by more than 2,000 living wages for able-bodied persons, it is proposed to impose a penalty of 4,000 to 5,000 non-taxable minimum incomes of citizens or community work for a period of 150 to 240 hours, or restraint of liberty for up to two years, or imprisonment for the same term, with deprivation of the right to hold certain positions for up to three years.

In addition, the bill proposes to amend Article 366-3 of the Criminal Code (failure to file a declaration by a person authorized to perform state or local government functions), according to which intentional failure to file a declaration is punishable by a fine of 2,500 to 3,000 non-taxable minimum incomes citizens or community work for a period of 150 to 240 hours, or imprisonment for up to two years, with deprivation of the right to hold certain positions for up to three years.

The campaign for declaring property and income for 2020 began in Ukraine on January 1.
